Terms of Service for HourlyIQ

Welcome to HourlyIQ, a service provided by Hourly Solutions Inc., a company incorporated under the laws of British Columbia, Canada (“we,” “us,” or “our”). By using our services, you agree to comply with these Terms of Service (the “Terms”).

1. Acceptance of Terms

By accessing or using HourlyIQ’s software (the “Service”), you agree to these Terms. If you do not agree, you must stop using the Service immediately.

2. Eligibility

The Service is available to businesses and individuals acting on behalf of businesses. You must be at least 18 years old and have the authority to bind your business to these Terms.

3. Account Registration and Security

To access the Service, you must create an account. You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account.

4. Service Description and CRM Integrations

HourlyIQ integrates with external Customer Relationship Management (CRM) systems to provide insights, reports, and strategic planning tools. By connecting your CRM to HourlyIQ, you authorize us to access and analyze your business data solely to deliver our Service.

We currently support integrations with Jobber and Housecall Pro, and other CRM systems as they are added.

5. Data Accuracy and User Responsibility

Disclaimer: We do not guarantee the accuracy or completeness of data imported from your CRM or any decisions based on our reports.

  • You are solely responsible for ensuring that data imported into HourlyIQ is correct and usable.
  • We are not liable for any business losses, missed opportunities, or damages resulting from incorrect or incomplete data provided by your CRM.

6. Permission to Use Data

By using the Service, you grant us the following rights to your data:

  • Processing and Analysis: You authorize us to access, process, and analyze your CRM data to generate business reports, insights, and performance recommendations.
  • Report Delivery: You agree that we may send you reports, summaries, or updates via email or physical mail using the contact information provided in your account.
  • Anonymized Global Reporting: We may use your data in an anonymized and aggregated form for research, service improvement, marketing, and industry benchmarking purposes. No personally identifiable information will be included in these reports.

7. Fees and Payment

7.1 Subscription Plans

  • The Service is offered on a subscription basis with different pricing tiers. Details on pricing and billing frequency will be provided during account registration or plan selection.

7.2 Free Trials

  • If applicable, free trials will automatically transition to paid plans unless canceled before the trial ends.

7.3 Payment Obligations

  • You agree to pay all fees associated with the subscription plan you select.
  • All payments are non-refundable unless otherwise specified in these Terms or required by law.

7.4 Billing Disputes

  • Any billing disputes must be reported in writing within 30 days of the charge in question. The maximum claim for any billing dispute will be limited to the value of one month of paid service.

8. Termination and Suspension

We reserve the right to suspend or permanently disable the account of any user for any reason, including but not limited to the following:

  • Violation of these Terms.
  • Failure to make timely payments.
  • Providing false or misleading information.

Upon termination, access to your account and data may be restricted or permanently disabled.

9. Data Privacy and Security

We are committed to protecting your data in accordance with our Privacy Policy.

9.1 Data Handling

  • Data imported from your CRM will be stored securely and used only as described in these Terms.

9.2 Data Retention

  • We will retain your data as long as necessary to provide the Service or as required by law.

9.3 Third-Party Services

  • We may engage third-party providers to assist with service delivery. These providers are bound by confidentiality agreements.

9.4 International Data Transfers

  • Your data may be processed outside your country of residence. We implement appropriate safeguards for cross-border data transfers.

10. Intellectual Property

10.1 Ownership

  • You retain ownership of all business data imported into HourlyIQ.
  • Hourly Solutions Inc. retains all rights to its software, algorithms, and proprietary features.

10.2 License to Use

  • We grant you a limited, non-transferable license to use HourlyIQ solely for your internal business purposes.

10.3 Protection of IP

  • You agree not to reverse engineer, copy, or misuse our proprietary software.

11. Liability Disclaimers

11.1 No Liability for Business Decisions

  • HourlyIQ is a decision-support tool. We are not liable for the outcome of business decisions made based on the insights or recommendations provided by the Service.

11.2 No Liability for CRM Data Accuracy

  • We disclaim liability for any inaccuracies, errors, or omissions in data imported from your CRM.

11.3 Limitation of Liability

  • To the maximum extent permitted by law, our total liability for any claim related to the Service will not exceed the amount you paid to us in the 6 months preceding the claim.

12. Warranties and Disclaimers

The Service is provided “as is” without any express or implied warranties, including but not limited to warranties of merchantability or fitness for a particular purpose.

13. Modifications to the Terms

We reserve the right to update these Terms at any time. We will notify you of any significant changes, and your continued use of the Service constitutes acceptance of the updated Terms.

14. Governing Law and Dispute Resolution

These Terms are governed by the laws of British Columbia, Canada. Any disputes will be resolved through binding arbitration in accordance with the rules of the British Columbia International Commercial Arbitration Centre.

16. Severability

These Terms constitute the entire agreement between you and Hourly Solutions Inc. regarding the use of the Service and supersede any prior agreements.

18. No Waiver

Our failure to enforce any right under these Terms will not be considered a waiver of those rights.
